Terms of Service

These Terms of Service (“Terms”) govern your access to and use of proestatecleanouts.com (the “Site”), operated by Pro Estate Cleanouts (“we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. The Service

The Site is a directory of estate sale, liquidation, cleanout, and property-clearing businesses. Businesses may submit new listings, claim ownership of existing listings, and pay for a recurring “Feature Listing” upgrade that sorts their listing higher in search and category results. We do not provide estate sale, liquidation, or cleanout services ourselves — we operate the directory only.

2. Accounts

To submit or claim a listing, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

3. Business Listings

When you submit a new listing or claim an existing one, you represent that you are authorized to act on behalf of that business and that the information you provide is accurate. New listings and ownership claims are subject to our review and approval before they go live or transfer ownership, and we may reject or remove a listing or claim at our discretion, including for inaccurate, misleading, or fraudulent information.

You grant us a non-exclusive, worldwide, royalty-free license to display the content you submit (business information and photos) on the Site for the purpose of operating the directory. You retain ownership of your content, and represent that you have the right to submit it, including any photos you upload.

4. Feature Listing Subscriptions & Billing

Feature Listing is a recurring monthly subscription billed at the price displayed at checkout, processed by Stripe, Inc. Your subscription renews automatically each month until canceled. You can manage or cancel your subscription at any time from your dashboard’s billing page. Fees already charged are non-refundable except where required by law. We may change the price of Feature Listing going forward with reasonable notice; changes will not apply to a billing period already in progress.

If a payment fails or a subscription is canceled, the associated listing will stop appearing as “Featured” but will remain listed in the directory as a standard listing.

5. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent business information
• Claim a business listing you are not authorized to represent
• Upload content that infringes someone else’s copyright or other rights
• Use the Site to harass, defame, or harm any person or business
• Use any automated means (bots, scrapers) to access or extract data from the Site without our permission
• Interfere with or disrupt the Site’s operation

We may suspend or terminate your account and remove any content for violating these Terms.

6. Third-Party Links

Listings may link to a business’s own website. We do not control and are not responsible for the content, accuracy, or practices of those third-party sites.

7. Intellectual Property & Copyright Complaints

The Site’s design, code, and branding are owned by Pro Estate Cleanouts. If you believe content on the Site infringes your copyright, contact us at support@proestatecleanouts.com with a description of the work, its location on the Site, and your contact information, and we will investigate and remove infringing content where appropriate.

8. Disclaimer of Warranties

The Site and its listings are provided “as is” without warranties of any kind. We do not verify the accuracy, quality, licensing, or insurance status of any business listed on the Site, and we do not endorse any listed business. You are solely responsible for evaluating any business you contact through the Site.

9. Limitation of Liability

To the maximum extent permitted by law, Pro Estate Cleanouts will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any interaction with a business listed on it, including any dispute, loss, or damage arising from services performed by a listed business.

10. Indemnification

You agree to indemnify and hold Pro Estate Cleanouts harmless from any claim or demand arising from your use of the Site, your content, or your violation of these Terms.

11. Dispute Resolution & Arbitration

Most concerns can be resolved by contacting us at support@proestatecleanouts.com. Any dispute arising from these Terms or your use of the Site that cannot be resolved informally will be settled by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and Pro Estate Cleanouts each waive the right to participate in a class action or class-wide arbitration.

12. Termination

You may stop using the Site and close your account at any time. We may suspend or terminate your access to the Site at our discretion, including for violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.

14. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above when we do. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
